These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and AutoMes ("AutoMes", "we", "us", "our") governing your access to and use of the AutoMes website, dashboard, and related services (together, the "Service"). Please read them carefully. By creating an account or using the Service, you accept these Terms.
By creating an account, connecting an Instagram account, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated here by reference. If you are using the Service on behalf of a business or other entity, you represent that you are authorised to bind that entity, and "you" refers to that entity. If you do not agree to these Terms, do not use the Service.
"Service" means the AutoMes platform. "Automation" means a rule you configure that sends a direct message in response to comments on your Instagram content. "Connected Account" means the Instagram Business or Creator account you authorise AutoMes to access. "Recipient" means an Instagram user who receives a message sent through the Service. "Content" means any message text, links, or media you configure the Service to send.
AutoMes is a software platform that enables Instagram Business and Creator account holders to automatically send direct messages to users who comment on their posts, and to run follow-gate flows that share a link once a commenter follows the account. AutoMes operates exclusively through Meta's official Instagram Graph API. AutoMes is an independent product and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc., Instagram, or any of their affiliates.
To use the Service you must: (a) be at least 18 years old and capable of forming a binding contract; (b) own, or be duly authorised to manage, the Instagram account you connect; (c) maintain that account as an Instagram Business or Creator account; and (d) comply at all times with Instagram's Terms of Use, Community Guidelines, and Meta's Platform Policies. We may refuse, suspend, or terminate access if we believe any eligibility requirement is not met.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly at automes849@gmail.com if you suspect any unauthorised use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.
You are solely responsible for the Content you send and the automations you configure. You agree NOT to use the Service to: send spam, bulk unsolicited messages, or content unrelated to the comment that triggered it; harass, threaten, deceive, or defraud any person; send illegal, obscene, hateful, or infringing content; impersonate any person or entity; promote scams, malware, or prohibited goods; or violate any applicable law or the rights of any third party. You must obtain any consent required by law before messaging a Recipient and must honour opt-out requests.
Your use of the Service must comply with Meta's Platform Terms, Developer Policies, and messaging policies, including limits on promotional messaging and the requirement to respect messaging windows. You must not use the Service in any way that could cause AutoMes to breach its obligations to Meta. If Meta restricts or revokes API access affecting the Service, we may modify or suspend affected features without liability to you.
We may offer a free trial tier with limited features and a limited monthly message allowance. We may change or discontinue the free tier at any time. Trial usage is subject to the same acceptable-use rules as paid plans.
Paid plans are billed in advance on a recurring monthly basis. All prices are stated in Indian Rupees (INR) and are exclusive of any taxes, which you are responsible for where applicable. Payments are processed by our payment partner, Razorpay; we do not store your card, UPI, or bank details. By subscribing you authorise recurring charges until you cancel. If a payment fails, we may retry it and may downgrade your account to the free tier until payment succeeds.
Each plan includes a monthly message allowance and a defined set of features. When you reach your monthly allowance, affected automations pause until the allowance resets at the start of your next billing cycle. Unused allowance does not roll over. We may reasonably adjust plan limits and features with notice.
You may cancel your subscription at any time from the billing section of your dashboard; cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, payments are non-refundable and we do not provide refunds for partial periods or unused allowance. If you believe you were charged in error, contact us at automes849@gmail.com within 7 days of the charge and we will review it in good faith.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, violate Meta's policies, generate spam complaints, create legal or security risk, or have amounts unpaid for more than 7 days. Suspensions or terminations for policy violations are not eligible for a refund. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnity, and governing law) will survive.
Using any third-party automation with Instagram carries inherent risk. Although AutoMes uses Meta's official API and is designed to operate within platform rules, we cannot guarantee that your Instagram account will never be rate-limited, restricted, or actioned by Meta. You use the Service at your own risk and we are not responsible for any action Meta takes against your account.
Recipients can opt out of automated messages at any time by replying "STOP" or "UNSUBSCRIBE". When we detect such a reply, we add the Recipient to a per-account blocklist and no further automated messages are sent to them from your Connected Account through the Service. You must not attempt to circumvent opt-outs.
The Service, including its software, design, and branding, is owned by AutoMes and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. You retain all rights to the Content you provide, and you grant us a limited licence to host, process, and transmit that Content solely to operate the Service on your behalf.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that messages will always be delivered, as delivery depends on Meta's systems and policies. We may perform maintenance or change features at any time.
To the maximum extent permitted by law, AutoMes and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or Instagram account access, arising out of or relating to your use of the Service. Our total aggregate liability for any claim will not exceed the amount you paid to AutoMes in the 30 days immediately before the event giving rise to the claim.
You agree to indemnify and hold harmless AutoMes and its owners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party, including Meta and any Recipient.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email or in-app. Changes take effect when posted. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We may also add, change, or discontinue features of the Service.
These Terms are governed by the laws of India, without regard to conflict-of-law principles. You agree that the courts located in India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before filing any claim, you agree to first contact us at automes849@gmail.com and attempt to resolve the dispute informally in good faith.
If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutoMes regarding the Service and supersede any prior agreements. Our failure to enforce any right is not a waiver of that right.
